Transport Canada has invoked a never-before-used capacity to force Nissan Canada to immediately inform owners of a defect that may cause dangerous fuel leaks.
The problem is present in X-Trail SUVs in the 2005 and 2006 model years, and involves a flaw within the fuel reservoir filler pipe coating that may result in fuel leaks if left unrepaired.
Nissan recalled the vehicles in 2014, but Transport Canada said it’s concerned that the company isn’t acting fast enough to repair them.

“Ordering Nissan to notify vehicle owners of this safety issue wasn’t taken lightly at Transport Canada,” Transport Minister Marc Garneau said inside a statement.
“I remain very concerned that Nissan isn’t doing enough to inform affected owners of this important recall.”
The transport minister was granted new powers last year that allow him to buy manufacturers to inform vehicle those who own a security issue. This marks the very first time this power, known as a subsequent notice order, has been utilized.
Nissan must take care of the expense of notifying owners, and will also be required to send Transport Canada quarterly progress reports on the recall.
Nissan Canada said hello has gotten an order and will continue to reach out to its customers.
“Nissan will continue to work collaboratively with Transport Canada, and will undertake the required actions to communicate with owners who’ve not responded to date, and finish repairs on all outstanding vehicles,” spokesman Didier Marsaud said in an email.
He added there happen to be no reported incidents or injuries related to the defect.
